Terms of service

Article 1 – Scope and Application

These Terms of Service (the “Terms”) govern the use of the online store operated by UN art (the “Store,” “we,” “us,” or “our”) and all related services provided through it (collectively, the “Services”).

By browsing or using the Services, or purchasing products from the Store, you are deemed to have agreed to these Terms and the contents of our separately published Privacy Policy, Refund Policy, Shipping Policy, and Disclosure under Japan’s Specified Commercial Transactions Act.

If specific conditions are stated on an individual product page, those conditions will take precedence over these Terms.

Article 2 – Use of the Services

You agree to use the Services in accordance with applicable laws, these Terms, and any other policies established by the Store.

When purchasing products or otherwise using the Services, you must provide accurate and up-to-date information, including your name, email address, shipping address, billing address, and any other information requested by the Store.

If you are a minor, you must obtain the consent of your parent or legal guardian before using the Services.

Article 3 – Customer Accounts

If you create an account, you are responsible for ensuring that your registration information remains accurate and up to date.

You are responsible for managing your login credentials. You may not transfer, lend, or share your account with any third party.

The Store shall not be liable for losses resulting from inadequate account management or unauthorized use by a third party where such losses are not attributable to the Store.

Article 4 – Product Information

We strive to display product colors, shapes, textures, sizes, and other specifications as accurately as possible.

However, actual products may appear slightly different from the images displayed on our website due to differences in devices, screen settings, browsers, and lighting conditions.

Please refer to each product page for details regarding dimensions, materials, borders, printing methods, packaging, whether a frame is included, and other specifications.

Product descriptions, prices, specifications, and purchase quantity limits may be changed without prior notice when necessary. However, orders for which a sales contract has already been formed will remain subject to the conditions presented at the time of purchase.

Article 5 – Orders and Formation of the Sales Contract

A sales contract between you and the Store is formed when you complete the checkout process and the order confirmation email sent by the Store reaches you.

However, even after an order has been accepted, we may conduct checks necessary to fulfill the order and cancel it where reasonable grounds exist, including the following circumstances:

・A product cannot be produced or supplied, has been discontinued, or is otherwise unavailable.
・Payment has not been successfully completed.
・The information you provided is incorrect or incomplete, making it difficult or impossible to fulfill the order.
・Fraudulent activity, unauthorized orders, or bulk purchases intended for resale are suspected.
・There is an obvious error in the listed product price, inventory quantity, or other published information.
・Other reasonable circumstances make fulfillment of the order impracticable.

If the information you provide is incorrect or incomplete, we may contact you to request clarification or correction. If the necessary information cannot be confirmed and the order cannot reasonably be fulfilled, we may cancel the order.

If an order is canceled, we will notify you and handle any applicable refund or other arrangements in accordance with relevant laws and our policies.

Article 6 – Prices and Payment

Product prices are displayed in US dollars (USD) on each product page. Any applicable taxes will be displayed at checkout.

In addition to the product price, shipping charges may apply as described in our Shipping Policy. The total amount payable will be displayed during checkout.

You may select a payment method from those available at checkout.

Payment timing, the date on which funds are debited, and other payment conditions are governed by the terms of the relevant credit card issuer, PayPal, or other payment provider.

Discounts, coupons, promotions, and special offers may be subject to additional terms and conditions.

Article 7 – Shipping and Delivery

Shipping charges, dispatch times, estimated delivery periods, shipping destinations, packaging methods, and other delivery conditions are governed by our separately published Shipping Policy or Shipping Information page.

Dispatch or delivery may be delayed due to the destination, weather, transportation conditions, carrier operations, natural disasters, or other circumstances beyond our control.

If an item is returned because of an incorrect shipping address provided by the customer, prolonged absence, refusal of delivery, or other circumstances attributable to the customer, the customer will be responsible for any shipping charges required for reshipment.

Article 8 – Order Changes and Cancellations

Once an order has been confirmed, we do not accept changes to products, sizes, quantities, shipping addresses, or other order details.

We also do not accept cancellations for personal reasons after an order has been confirmed.

If we are unable to supply a product for reasons attributable to the Store, we will provide individual guidance regarding cancellation or a refund.

Article 9 – Returns, Exchanges, and Refunds

Returns, exchanges, and refunds are governed by our separately published Refund Policy or Returns and Exchanges Policy.

We do not accept returns or exchanges for personal reasons, including differences in expected color or appearance, ordering the wrong size or product, or no longer wanting an item after purchase.

If an item arrives damaged, has a printing defect or another quality issue, or differs from what was ordered, please contact us within 7 days of delivery. We will review the condition of the item and advise you regarding an exchange or refund.

We may be unable to accept returns, exchanges, or refunds for items sent back without contacting us in advance.

If a return or exchange is required due to damage, defects, incorrect fulfillment, or other circumstances attributable to the Store, we will cover the necessary shipping costs.

Article 10 – Intellectual Property Rights

All copyrights, trademarks, and other intellectual property rights relating to artwork, product images, photographs, illustrations, text, logos, designs, videos, trademarks, and other content published through the Services belong to the Store or the respective rights holders who have lawfully authorized their use by the Store.

Except to the extent permitted by law for private use or other lawful purposes, you may not reproduce, republish, modify, distribute, sell, publicly transmit, or commercially exploit such content without prior permission from the Store or the relevant rights holder.

Purchasing a product does not transfer copyright or any other intellectual property rights in the artwork to the purchaser.

Article 11 – Prohibited Conduct

When using the Services, you must not engage in any of the following activities:

・Violating applicable laws or public order and morals.
・Infringing the copyrights, trademarks, privacy rights, or other rights of the Store or any third party.
・Submitting or transmitting false information.
・Impersonating another person.
・Engaging in fraudulent payments, unauthorized orders, or activities intended to avoid payment.
・Making bulk purchases for resale or other commercial purposes without prior authorization from the Store.
・Interfering with the operation of the Services, servers, or networks.
・Transmitting viruses or other harmful programs.
・Unlawfully collecting, reproducing, or using information from the Services.
・Causing harm, loss, or inconvenience to the Store, other customers, or third parties.
・Engaging in any other conduct that the Store reasonably determines to be inappropriate.

If you violate these Terms, we may take necessary measures, including canceling orders or suspending access to your account.

Article 12 – Third-Party Services

The Services may utilize third-party services provided by Shopify, payment providers, shipping carriers, and other companies.

Your use of these external services may be subject to the respective providers’ terms of service and privacy policies.

The Store shall not be liable for disruptions, interruptions, or the handling of information by third-party services where such matters are not attributable to the Store.

Article 13 – Links to Third-Party Websites

The Services may contain links to websites or online services operated by third parties.

The content, products, services, accuracy, and security of information provided through those websites are the responsibility of their respective operators. Please review the applicable terms and conditions before using any third-party website.

Article 14 – Personal Information

Your personal information will be handled in accordance with our separately published Privacy Policy.

The Services are provided using Shopify. Personal information may be shared with Shopify, payment providers, shipping providers, and other service providers to the extent necessary for order processing, payment, delivery, and the provision of the Services.

Article 15 – Changes, Interruptions, and Suspension of the Services

We may modify, interrupt, or suspend all or part of the Services due to system maintenance, technical failures, security concerns, natural disasters, interruptions to third-party services, or other unavoidable circumstances.

Where reasonably possible, we will provide advance notice. However, in urgent situations, changes or interruptions may occur without prior notice.

Article 16 – Liability

If an issue arises due to damage, defects, incorrect fulfillment, or other circumstances attributable to the Store, we will respond in accordance with applicable laws and our Refund Policy.

Nothing in these Terms excludes or limits our liability to the extent that such exclusion or limitation is prohibited by applicable law.

Any limitation or exclusion of liability contained in these Terms shall not apply to losses caused by our intentional misconduct or gross negligence.

We shall not be liable for losses caused by telecommunications networks, devices, external services, shipping carriers, weather, natural disasters, or other circumstances beyond our responsibility, except where liability is imposed by applicable law.

Article 17 – Changes to These Terms

We may revise these Terms as necessary in accordance with applicable law.

If these Terms are amended, we will notify customers of the changes and their effective date by publishing the relevant information through the Services or by another appropriate method.

The revised Terms will take effect on the date specified by the Store.

Article 18 – Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect.

Article 19 – Governing Law and Jurisdiction

These Terms and any sales contracts between the Store and customers shall be governed by the laws of Japan.

Any disputes between the Store and customers shall be subject to the jurisdiction of the courts of Japan having jurisdiction under the Japanese Code of Civil Procedure and other applicable laws.
